1. Introduction and Acceptance

1.1 These Terms and Conditions (the “Terms”) govern your use of our website and the purchase of goods from our online store operated by Downham Garden Centre (trading as Downham Garden Centre) located at 14 Railway Road, Downham Market, Norfolk PE38 9EB.

4.2 All prices include VAT at the current rate and are displayed in GBP. We reserve the right to correct errors in pricing or descriptions.

5. Delivery

We aim to deliver goods within the timeframe specified in your order confirmation. Full details of delivery charges and estimated times will be provided at checkout.

6. Cancellation and Returns

6.1 You have the right to cancel your contract within 14 days of receiving goods, without giving any reason, in accordance with Consumer Contracts regulations.
6.2 To cancel, notify us in writing using the contact details at the foot of this document. We will refund you within 14 days of receiving your notice, excluding standard delivery costs. You must return the goods in a reasonable condition (with the exception of any checks necessary to ascertain their nature and condition).

7. Consumer Rights – Faulty or Mis-described Goods

7.1 Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose, and as described.
7.2 If goods are faulty or not as described, you are entitled to a refund within 30 days of delivery, or we may offer repair or replacement thereafter.

8. Intellectual Property

All content on the site, including texts, images, logos, and designs, remains our property or that of our licensors. Use is strictly prohibited unless expressly authorised.

9. Limitation of Liability

Except as expressly stated, we shall not be liable for:

  Liability for death or personal injury caused by negligence, or matters which must not under UK law be excluded or limited, remains unaffected.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales. Disputes will be dealt with exclusively by the courts of England and Wales.
